The Council of State, which was asked to justify the dissolution of the Génération Identitaire association, which was carried out purely arbitrarily by the Council of Ministers on March 3, 2021 at the suggestion of Interior Minister Gérald Darmanin, has now decided in favor of the government and confirmed the dissolution in a fast-track process. As the former MEP Jean-Yves Le Gallou analyzes, “the Council of State confirms that it has finally broken with the defense of the French freedoms to turn France into a vulgar immigration office”.
The lawyer Pierre Gentillet sees in this decision of the Council of State, which he says is “of incredible need”, the harbinger of a “very uncertain future for freedom of expression in France.
For Pierre Gentillet, the Council of State also creates an offense of opinion in its judgment that relates to criticism of immigration:
“We are clearly entering a very dangerous area, because the idea behind this is that any criticism of an organization of immigration or of Islam can from now on come under the sanction of dissolution. On this basis, even political parties like the Rassemblement National or Debout La France could be dissolved tomorrow. “
