A hearing has been announced for the trial of those responsible in the Patria case: Among the defendants is Masleša

The hearing for the trial of those responsible in the Patria case is known. The Constitutional Court of the Republic of Slovenia closed the case at the end of June and declared Janez Janša innocent. Thus ended a more than 15-year saga aimed at morally contaminating the prominent statesman and allowing him to be imprisoned just before the elections. Among the defendants is the Supreme Judge Masleša, who is allegedly deficient in education.

The preliminary hearing and the first hearing for the main hearing for the trial of those responsible in the Patria case are known. The plaintiff is Ivan Janez Janša, and his representative is lawyer Franci Matoz. The defendants are: Branka Zobec Hrastar, Barbara Klanjšek, Milan Štrukelj, Vesna Žalik, Branko Masleša, and the Republic of Slovenia. The preliminary hearing and the first hearing for the main hearing in this litigation is scheduled for November 15th, 2022, at 9 a.m. at the District Court in Kranj.

The client must personally attend the preliminary hearing and answer the court’s questions in person. Below is some other information regarding possible representation before the district courts. It is also stated that the party that did not attend the preliminary hearing must reimburse the opposing party for the costs of this hearing at its request. In addition, he loses the right to request the reimbursement of further costs of the proceedings before the court of first instance.

In the event that the procedure is concluded with the conclusion of a court settlement, the court will return part of the court fee to the plaintiff in accordance with the provisions of the law governing court fees. However, if the preliminary hearing does not end with the conclusion of a court settlement, the court can immediately start the main hearing. At the first hearing for the main hearing at the latest, the party must state all the facts necessary to justify its proposals, offer the evidence necessary to establish its allegations, and declare itself about the allegations and the evidence offered by the opposing party.

Let’s remember: on June 28th, 2022, we reported that the Constitutional Court of the Republic of Slovenia closed the case and declared Janša innocent. “After more than 15 years of the saga of the Patria Affair, the Slovenian caricature of the rule of law ended the case with a declaration of innocence,” former Prime Minister Janša wrote on Twitter at the time, adding that the Constitutional Court, after much hesitation, rejected their appeal against the statute of limitations and messaged, that their decision has the same legal consequences as an acquittal. The internationally resounding construct Patria enabled the Slovenian courts to put the leader of the opposition in prison just before the elections. By the way: the Supreme Judge Masleša, involved in the case, attracted a lot of attention months ago due to questions about his education.
